Dear CYAUSE,

 

I am looking for a comprehensive, fully compliant structure rather than simply a one-off tax calculation, and I am more than happy to book and pay for a consultation.

 

My activity is primarily Solana- and Ethereum-based memecoin trading – high-frequency discretionary trading. In practical terms it looks like this:

 

  • Holding SOL and ETH in self-custody wallets.
  • Buying and selling large numbers of different tokens throughout the day on the Solana and Ethereum blockchains.
  • Potentially executing dozens to hundreds of transactions or swaps per day: SOL to memecoin, then memecoin back to SOL.
  • Periodically consolidating profits into stablecoins.
  • Eventually converting part of the accumulated crypto into EUR or USD through regulated exchanges, brokers or OTC providers, and transferring the fiat to my bank account.

 

I am not intending to provide any services to others, nor to mine. My income is derived one hundred per cent from memecoin trading. My annual income is in the high six figures, and the trading is purely proprietary, using my own capital.

 

My understanding is that from 1 January 2026 Cyprus introduced the Article 20E regime, under which qualifying crypto-asset disposal gains are subject to an 8% special tax. Because I execute so many transactions on a daily basis – buying memecoins with ETH or SOL and then selling them seconds later – my question is whether every single one of these transactions needs to be tracked, or whether we can compute a monthly or annual realised profit and pay 8% on that, with losses respected.

 

To give an example: I may trade 300 different memecoins in a day, buying them so that my SOL or ETH is converted into a given token, then selling that token at a profit – and sometimes at a loss. Those losses should be respected. After an entire day this may look like 300 transactions, 180 profitable and 120 at a loss, with a total net profit of USD 2,000.

 

I would like to set up the best way to engage in exactly that activity. I am an EU passport holder and have lived in the UAE for the last few years, but I want to come to Cyprus. I am happy with non-dom status or whatever you suggest. If possible I would also like assistance with setting up banking. I am looking to engage your firm for the move, the set-up, and as a long-term partner on a retainer basis.

Dear Client,

 

Thank you for setting out your activity so clearly – it makes the analysis far easier, and it also makes plain why the record-keeping question is the one that matters most in your case.

 

The short answer is that every swap is a separate taxable disposal, so every one of them has to be tracked. What you may do at the level of the tax return is aggregate: the 8% is charged on the net result for the tax year, not transaction by transaction. But you can only arrive at that net figure lawfully if the underlying per-disposal records exist behind it. A monthly or annual profit-and-loss figure taken straight from an exchange dashboard, with no transaction-level substantiation, is not an acceptable basis for a Cyprus tax return.

 

1. What Article 20E actually says

 

Article 20E was inserted into the Cyprus Income Tax Law (Law 118(I)/2002) by the Income Tax (Amending) (No. 4) Law of 2025, published in the Official Gazette on 31 December 2025 and applying to tax years beginning on or after 1 January 2026. It is the first provision in Cyprus law written specifically for crypto-assets, and it taxes gains arising on the disposal of crypto-assets at a flat rate of 8%. The rate does not step up with the size of the gain, and it applies to individuals and companies alike.

 

The definitions of “crypto-asset” and “disposal” follow the EU Markets in Crypto-Assets Regulation (Regulation (EU) 2023/1114, “MiCA”). That matters to you directly, because a disposal is far wider than a cash-out.

Source: Article 20E of the Income Tax Law as introduced by the Income Tax (Amending) (No. 4) Law of 2025; definitions aligned to Regulation (EU) 2023/1114 (MiCA). The 8% rate on gains from crypto-assets is also confirmed in the Ministry of Finance summary of the 2026 tax reform measures.

 

2. Your 300-trade day, worked through

 

Take your own example: 300 trades in a day, 180 profitable, 120 at a loss, a net result of roughly USD 2,000. On the Cyprus analysis, that day did not produce one taxable event. Each purchase of a token with SOL is a disposal of SOL, and each sale of that token back into SOL is a disposal of the token. Your 300 round trips are therefore closer to 600 disposals, each of which needs a euro-denominated acquisition cost and a euro-denominated disposal value at the moment of the transaction.

 

The tax return then reports the aggregate. Gains and losses on crypto-asset disposals are netted, and 8% is applied to the net gain. So the outcome you were hoping for – pay 8% on the net – is broadly the right outcome. What is not right is the idea that you can reach it without the underlying data. The netting is the last step of the calculation, not a substitute for it.

 

In practice this is a data problem before it is a tax problem. At your volumes you should expect somewhere in the order of one hundred thousand or more taxable disposals in a year. That is entirely manageable, but only with a proper on-chain extraction and reconciliation process feeding into the accounting records, and with a consistent, documented cost-basis convention applied from day one. Retro-fitting this after two years of trading is where the cost and the exposure arise.

 

3. The point most traders miss: your losses expire

 

This is the part of Article 20E that deserves your attention more than the rate does. Losses on the disposal of crypto-assets may be set off only against gains on the disposal of crypto-assets, and only within the same tax year. They cannot be carried forward, and they cannot be used to reduce your other taxable income.

 

The consequence is stark for a high-frequency trader. A year in which you are up EUR 400,000 by September and give back EUR 380,000 by December leaves you taxed on roughly EUR 20,000 – which is correct and welcome. But a year in which you are up EUR 400,000 and a following year in which you are down EUR 380,000 leaves you taxed on the full EUR 400,000, with the later loss simply lost. The tax year, not the trading cycle, is the unit of account.

 

The planning implication is that the timing of realisations around each 31 December genuinely matters, and that unrealised positions should be reviewed before the year end rather than in the following spring. We would want to look at this with you each December rather than each April. We should also note that the precise mechanics of loss relief are an area where we would seek written confirmation from the Tax Department for a portfolio of your size, and we would not want you to rely on a general summary for a figure of that magnitude.

 

4. Individual or Cyprus company?

 

Article 20E applies to any person, so the 8% rate is available whether you trade in your own name as a Cyprus tax resident individual or through a Cyprus company. That is an important point, because it removes the usual reason for incorporating – you are not incorporating to reach a lower rate. The choice turns on other factors.

For a purely proprietary trader with no third-party clients, the company is usually chosen for banking, credibility and audit trail rather than for rate arbitrage. Given that you also want a retainer relationship and assistance with banking, a company is likely to be the more practical route – but we would want to confirm that against your actual counterparties before recommending it, since the answer depends on which exchanges and OTC desks you intend to use.

 

5. Becoming Cyprus tax resident, and the non-dom position

 

Article 20E is only useful to you once you are actually within the Cyprus tax net. There are two routes to Cyprus tax residency for an individual:

 

  • The 183-day rule – physical presence in Cyprus for more than 183 days in the calendar year.
  • The 60-day rule – at least 60 days in Cyprus, no more than 183 days in any other single state, an ongoing business, employment or directorship in Cyprus, and a permanent residence in Cyprus that is owned or rented. This route no longer requires you to prove non-residence elsewhere, but it does require genuine economic connection, which a Cyprus company and directorship would provide.

 

On top of residency sits non-domiciled status. As an individual who has not been Cyprus tax resident for 17 out of the last 20 years, you would ordinarily qualify, and non-dom status removes Special Defence Contribution on dividends and interest for a period of 17 years. That is what makes the company route efficient at the extraction stage. General Healthcare System contributions still apply on relevant income, subject to the annual cap, so the effective leakage on a company structure is 8% at the trading level plus capped health contributions on what you draw out.

 

As an EU passport holder your immigration position is straightforward: you would register for a residence certificate (the “yellow slip”) rather than needing a permit. Moving from the UAE, we would also want to look carefully at the exit side – when your UAE position ends, and how the year of transition is presented – because the cleanest outcome is usually to make the move effective from the start of a calendar year rather than part-way through one.

 

6. Banking – the honest answer

 

We can introduce you to banks and to electronic money institutions and we do this regularly, but we would not want to promise you an outcome. Crypto-derived wealth attracts enhanced due diligence everywhere in the EU, and the practical obstacle is rarely the account opening itself – it is the source-of-wealth file. Institutions will want to see how the original capital was acquired, an unbroken trail from that point to the funds arriving, and evidence that the trading has been declared. The same transaction-level records that Article 20E requires are what make that file possible, which is another reason to build the process before you start rather than after.

 

Where a client arrives with several years of undocumented trading history behind them, the banking conversation becomes materially harder, and in some cases it does not succeed at all. We would rather say that now than discover it later.

 

7. What we would suggest as next steps

 

  1. A paid consultation to map your existing holdings, your intended move date and your counterparties, so that the structure is decided on facts rather than assumptions.
  2. A decision on personal versus corporate trading, taken together with the banking route rather than separately from it.
  3. Implementation of the on-chain data extraction and reconciliation process before the first Cyprus tax year begins.
  4. Where the amounts justify it, a written tax opinion or an advance ruling application confirming the treatment of your particular pattern of disposals, including the loss position.
  5. Company formation, non-dom registration and residence certificate, sequenced so that the residency and the trading start in the same tax year.
