20,000 Swaps a Month, 8% Tax — but Only If You Can Prove Every Single One

20,000 Swaps a Month, 8% Tax — but Only If You Can Prove Every Single One

Dear CYAUSE,

I am looking for a comprehensive, fully compliant structure rather than simply a one-time tax calculation, and I am happy to book and pay for a consultation.

My activity is primarily Solana- and Ethereum-based memecoin trading — high-frequency discretionary trading. In practical terms it looks like this: I hold SOL and ETH in self-custody wallets; I buy and sell large numbers of different tokens throughout the day on the Solana and Ethereum blockchains; I may execute dozens to hundreds of swaps per day, SOL into a token and the token back into SOL; I periodically consolidate profits into stablecoins; and eventually I convert part of the accumulated crypto into euro or dollars through regulated exchanges, brokers or OTC providers and transfer the fiat to my bank account.

I am not intending to provide any services to others, and I do no mining. My income is derived entirely from memecoin trading and is in the high six figures annually. The trading is purely proprietary, using my own capital.

My understanding is that from 1 January 2026 Cyprus has introduced the Article 20E regime, under which qualifying crypto-asset disposal gains are subject to an 8% tax. Because I execute so many transactions on a daily basis — buying memecoins with SOL or ETH and selling them seconds later — my question is whether every single one of these transactions needs to be tracked, or whether we can take a monthly or annual realised profit and pay 8% on that figure, respecting losses.

To give an example: I may trade 300 different tokens in a day. I buy them, so my SOL or ETH is converted into a token, and then I sell that token for a profit, and sometimes for a loss. Those losses should be respected. After an entire day this may look like 300 transactions, 180 profitable and 120 at a loss, with a net result of, say, +US$2,000.

I would like to set up the best way to engage in exactly that activity. I am a German passport holder. I have lived in the Gulf for the last few years and now want to come to Cyprus. I am happy with non-dom or whatever you suggest, and if possible I would also like assistance with setting up banking. I am looking to engage your firm for the move, the set-up, and as a long-term partner on a retainer basis.

Kind regards,

Dear Client,

Thank you for setting the activity out so clearly — it makes the answer much easier to give.

1. The direct answer: yes, every transaction

To answer your central question first: yes, every single disposal must be tracked and reconciled individually. There is no monthly or annual netting shortcut. The 8% is charged on the profit arising from the disposal of crypto assets, and a crypto-to-crypto swap is itself a disposal. Each swap therefore needs an acquisition cost and a disposal value, expressed in euro at the moment it executed.

The distinction worth holding on to is this: the figure you report is a single annual number, but it is the sum of those individual computations, not a substitute for them. You file one number; you must be able to build it from the transaction level up and defend it if asked. For an activity at your volume, that is the whole of the compliance work.

2. What Article 20E actually provides

Your understanding of the regime is correct. Article 20E was inserted into the Income Tax Law by the Income Tax (Amending) (No. 4) Law of 2025. The House of Representatives voted the tax reform package into law on 22 December 2025 and it was published in the Official Gazette on 31 December 2025, applying to tax years beginning on or after 1 January 2026.

The features that matter most on your facts are these:

  • The rate is 8% on profits arising from the disposal of crypto assets, and the provision applies to any person — individuals and companies alike. The older argument about whether a taxpayer was an investor or a frequent trader no longer determines the outcome, which is helpful for an activity like yours.
  • The profit taxed at 8% is ring-fenced. It is not aggregated with your other income and does not run through the progressive personal income tax bands, which reach 35%.
  • “Disposal” is wider than selling for fiat. Exchanging one crypto asset for another, using crypto to pay for goods or services, and transferring crypto away without consideration are all disposals.
  • Profit is proceeds less acquisition cost and expenses directly related to the disposal.
  • Mining sits outside the regime and is taxed at ordinary rates. Staking and similar rewards are generally treated as ordinary income when received, with a later disposal of the tokens received falling under Article 20E.

On the facts you describe — proprietary trading with your own capital, no services supplied to third parties, no mining — the activity should fall within Article 20E rather than outside it. It is worth saying plainly why that is a good position: not only the headline rate, but the ring-fence behind it.

The table below shows what the ring-fence is worth in practice.

Cyprus personal income tax, 2026 bands Rate
Up to €22,000 0%
€22,001 – €32,000 20%
€32,001 – €42,000 25%
€42,001 – €72,000 30%
Above €72,000 35%
Crypto-asset disposal profit under Article 20E 8%, not aggregated with the bands above

3. What 20,000 monthly transactions actually reduce to

Take a month in which your strategies generate 20,000 on-chain interactions. The taxable population is a fraction of that figure, but the file has to begin with all of it. The illustration below is built on assumed volumes to show the shape of the work, not to predict your own numbers.

Stage Illustrative volume Treatment
Total on-chain interactions ingested 20,000 All retained in the working file for the fiscal year, whether taxable or not
Non-taxable events filtered out — failed transactions, contract approvals, internal wallet-to-wallet transfers, wrapping and unwrapping — Removed from the taxable population; documented so the exclusion can be evidenced
Acquisitions (the buy side of each trade) — Not disposals; they establish cost basis in euro at execution
Loss-making disposals — Aggregated and set against crypto gains of the same tax year
Profitable disposals — the taxable line items approx. 2,000 8% on the net profit for the year

At the line-item level, the working papers record each taxable disposal individually. If one trade converted a token back into SOL for a profit of €500, the ledger logs the entry timestamp, the exit timestamp, the cost basis, the proceeds and the €40 of tax arising on that single trade, before everything is rolled up into a consolidated annual computation.

4. Your losses are respected — but they expire on 31 December

This is the point your enquiry does not yet account for, and it is the one we would most want you to understand before you commit to a structure.

Losses on the disposal of crypto assets are respected, but less generously than the phrase “respecting losses” might suggest. They may be set off only against profits from the disposal of crypto assets of the same person, and only within the same tax year. They cannot be carried forward to a later year, they cannot be carried back, they cannot be offset against your other income — salary, interest, dividends or trading profits of another kind — and they are not available for group relief.

For a trader at your volume this is a real timing exposure rather than a technicality. A drawdown in December shelters December gains; it does nothing at all for the following January. No amount of record-keeping fixes it, because it is a consequence of the ring-fence rather than of the file. It is, however, a strong reason to look at realisation timing before a year end rather than after one, and it is the kind of thing a retainer relationship exists to watch.

5. What a defensible file has to contain

At minimum, you need to be able to substantiate the following:

  • Acquisition date, quantity and cost base for each position, including transaction fees.
  • Disposal date and proceeds for each disposal, with the euro fair market value at execution wherever the disposal is a crypto-to-crypto swap or a payment made in crypto.
  • The classification of each transaction — an Article 20E disposal, or other income such as staking rewards — so that the two populations never blur.
  • An annual computation demonstrating that crypto losses have been set only against crypto gains of the same tax year.
  • A clean segregation of pre-2026 and post-2026 positions.
  • Source of funds evidence tracing the origin of your trading capital back to its fiat or initial crypto roots.
  • Proof of ownership and control of the wallets executing the trades, confirming that this is proprietary trading rather than the management of other people’s assets.

On cost-basis methodology: first-in-first-out is the approach most commonly applied in practice, and average cost is used where it is clearly documented. We would flag, however, that the accepted method is one of the areas on which detailed Tax Department guidance was still awaited at the time of writing. We would not want you to build two years of working papers on an assumption that later guidance contradicts, and for an activity of your size this is one of the points worth settling in advance and in writing.

For completeness, we should also be candid about one open question. Whether General Healthcare System contributions attach to Article 20E disposal profits is not settled by published guidance, and we would confirm the position for your circumstances rather than assume it either way. What is clear is that where you draw a salary or dividends from a Cyprus company, General Healthcare System contributions of 2.65% apply to that income up to the annual cap of €180,000, and that a self-employed person contributes at 4% together with Social Insurance at 16.6% up to the insurable-earnings ceiling.

6. Banking: what an assurance report can and cannot do

European banks and electronic money institutions frequently decline high-volume crypto traders, not out of hostility but because their compliance teams cannot underwrite on-chain risk or verify a source of funds they have no means of reading. The practical answer is to package the source of funds analysis, the proof of ownership and control, and the transaction ledgers into a formal assurance report that translates on-chain activity into a standardised financial dossier in the format a compliance officer works with every day.

That materially improves your chances, and in our experience it is the difference between a conversation and a refusal at the first hurdle. It is not a guarantee: no adviser can commit a bank or an institution to a decision, each one applies its own risk appetite, and we would not present the report as anything more than the best available answer to the question they will ask. Expect follow-up questions, and expect to be able to answer them.

7. Residency, non-dom and the order of operations

One clarification that often saves disappointment: the 8% applies because of the character of the income, not because of non-dom status. Non-dom is what removes the Special Defence Contribution from dividends and interest for those who have not been Cyprus tax resident for 17 of the last 20 years. The two reliefs are separate, and you need the residency properly documented in either case.

Cyprus tax residency can be established either by spending more than 183 days in the country in a calendar year, or under the 60-day rule, which requires 60 days of presence together with a permanent home maintained in Cyprus and either employment, business activity or an office holding here. The 60-day rule no longer requires you to prove non-residence in another state, which simplifies a move from the Gulf considerably. Whether you trade personally or through a Cyprus company is a separate question, and one worth deciding before the first disposal of the new year rather than after it.

8. Suggested next steps

We would propose a paid consultation to settle the structure, the residency route and the year-one timetable, and to scope the reporting infrastructure against your actual wallet inventory and transaction volumes. Where a specific treatment needs to be certain rather than probable — the cost-basis method being the obvious candidate on your facts — written confirmation, or a formal ruling from the Tax Department, is the route we would recommend before the volumes accumulate.

If it would help, we are happy to start with whichever single point is blocking your decision and come back to you on that alone.

Kind regards,
